1. Applicable Warranties<\/h2>\n\n\n\n

Products sold by EON SCUTI, S.L. (\u201cSCUTI\u201d) benefit from the SCUTI commercial warranty described below.<\/p>\n\n\n\n

Individual customers residing in the European Union also benefit from the statutory guarantee of conformity applicable to them.<\/p>\n\n\n\n

This statutory guarantee covers defects in conformity that were present at the time of delivery, including when they become apparent later under the conditions provided for by law.<\/p>\n\n\n\n

Its duration may vary from one country to another. In Spain, it is 3 years from delivery<\/strong> for new products.<\/p>\n\n\n\n

The SCUTI commercial warranty is in addition to the statutory guarantee where applicable.<\/p>\n\n\n\n

2. Statutory Guarantee of Conformity<\/h2>\n\n\n\n

The statutory guarantee of conformity concerns defects already present at the time of delivery.<\/p>\n\n\n\n

When a defect covered by this guarantee is confirmed, SCUTI ensures that the product is brought into conformity under the conditions provided for by law, in particular by repair or replacement.<\/p>\n\n\n\n

SCUTI must be able to examine the problem and carry out the necessary checks before determining the appropriate course of action.<\/p>\n\n\n\n

The customer must provide the information requested by our after-sales service and follow the diagnostic or return instructions communicated to them.<\/p>\n\n\n\n

3. SCUTI Commercial Warranty<\/h2>\n\n\n\n

The SCUTI commercial warranty covers manufacturing defects occurring during normal use and maintenance of the product.<\/p>\n\n\n\n

For new products, the warranty periods are as follows:<\/p>\n\n\n\n

    \n
  • motors, controllers, electronic boards and displays: 2 years or 3,500 km<\/strong>, whichever occurs first;<\/li>\n\n\n\n
  • batteries: 1 year or 3,500 km<\/strong>, whichever occurs first;<\/li>\n\n\n\n
  • chargers: 2 years<\/strong>.<\/li>\n<\/ul>\n\n\n\n

    The warranty begins on the date of delivery of the product.<\/p>\n\n\n\n

    The repair or replacement of a part does not renew the original duration of the commercial warranty and does not reset its mileage limit.<\/p>\n\n\n\n

    For used, refurbished, display or demonstration products, the applicable commercial warranty is the one indicated at the time of purchase.<\/p>\n\n\n\n

    4. Exclusions<\/h2>\n\n\n\n

    Damage or malfunctions resulting in particular from the following are not covered:<\/p>\n\n\n\n

      \n
    • normal wear and tear;<\/li>\n\n\n\n
    • a fall, impact, collision or accident;<\/li>\n\n\n\n
    • abusive, excessive or inappropriate use;<\/li>\n\n\n\n
    • competition, jumps or stunts;<\/li>\n\n\n\n
    • intensive use as part of a rental activity;<\/li>\n\n\n\n
    • water or liquid ingress;<\/li>\n\n\n\n
    • excessive humidity, oxidation or corrosion;<\/li>\n\n\n\n
    • exposure to extreme temperatures or unsuitable conditions;<\/li>\n\n\n\n
    • overheating, overloading or a short circuit;<\/li>\n\n\n\n
    • insufficient or incorrect maintenance;<\/li>\n\n\n\n
    • improper storage;<\/li>\n\n\n\n
    • deep discharge or improper battery storage conditions;<\/li>\n\n\n\n
    • the use of a non-original, incompatible or unsuitable charger;<\/li>\n\n\n\n
    • the installation of incompatible parts or accessories;<\/li>\n\n\n\n
    • an unauthorised electrical, electronic, mechanical or software modification;<\/li>\n\n\n\n
    • a modification of the firmware, controller or its settings that may damage the product;<\/li>\n\n\n\n
    • modification or falsification of the mileage;<\/li>\n\n\n\n
    • removal, alteration or falsification of the serial number;<\/li>\n\n\n\n
    • an unauthorised intervention or repair that caused or aggravated the problem.<\/li>\n<\/ul>\n\n\n\n

      5. Wear Parts<\/h2>\n\n\n\n

      Normal wear and tear of a product and its components does not constitute a defect covered by the warranty.<\/p>\n\n\n\n

      This includes in particular:<\/p>\n\n\n\n

        \n
      • tyres and inner tubes;<\/li>\n\n\n\n
      • brake pads and brake discs;<\/li>\n\n\n\n
      • cables;<\/li>\n\n\n\n
      • bearings;<\/li>\n\n\n\n
      • bushings and suspension components subject to wear;<\/li>\n\n\n\n
      • rubber parts;<\/li>\n\n\n\n
      • handles;<\/li>\n\n\n\n
      • mudguards;<\/li>\n\n\n\n
      • footrests;<\/li>\n\n\n\n
      • lights and LEDs;<\/li>\n\n\n\n
      • covers and cosmetic components;<\/li>\n\n\n\n
      • fasteners;<\/li>\n\n\n\n
      • more generally, parts whose wear depends directly on use or mileage.<\/li>\n<\/ul>\n\n\n\n

        El progressive decrease in a battery\u2019s capacity or range due to its age, number of cycles or normal use<\/strong> also constitutes normal wear and tear.<\/p>\n\n\n\n

        6. Warranty Claim<\/h2>\n\n\n\n

        Any warranty claim must be submitted through the after-sales service form available on the Site.<\/p>\n\n\n\n

        To enable diagnosis, SCUTI may request, in particular:<\/p>\n\n\n\n

          \n
        • the order number;<\/li>\n\n\n\n
        • a description of the problem;<\/li>\n\n\n\n
        • the vehicle mileage and its serial number;<\/li>\n\n\n\n
        • photographs or videos;<\/li>\n\n\n\n
        • any error codes;<\/li>\n\n\n\n
        • the circumstances in which the problem occurred;<\/li>\n\n\n\n
        • any other useful technical information.<\/li>\n<\/ul>\n\n\n\n

          SCUTI may also ask the customer to carry out certain technical checks.<\/p>\n\n\n\n

          The handling of the case may be suspended until the necessary information has been provided or the requested checks have been carried out.<\/p>\n\n\n\n

          The customer must follow the instructions communicated by our after-sales service.<\/p>\n\n\n\n

          No repair, intervention or expense with a third-party workshop or technician may be undertaken in SCUTI\u2019s name or at SCUTI\u2019s expense without our prior written authorisation.<\/strong><\/p>\n\n\n\n

          An intervention carried out without such authorisation does not constitute acceptance of coverage by SCUTI.<\/p>\n\n\n\n

          7. Return, Transport and Packaging<\/h2>\n\n\n\n

          When a return is necessary in order to continue the diagnosis or carry out a repair, SCUTI provides the customer with the procedure to follow.<\/p>\n\n\n\n

          Where possible, SCUTI may assist in arranging the collection of vehicles located in the continental European Union<\/strong> through its partner carriers.<\/p>\n\n\n\n

          This service is not guaranteed and depends on the areas actually served, the product concerned and the collection options offered by our carriers.<\/p>\n\n\n\n

          For islands, non-continental territories or other areas not served, the customer may be required to arrange the transport themselves.<\/p>\n\n\n\n

          A customer who arranges the shipment themselves must inform SCUTI in advance and comply with the instructions communicated by our after-sales service.<\/p>\n\n\n\n

          No product must be shipped to SCUTI without prior authorisation or outside the communicated return procedure.<\/p>\n\n\n\n

          Before shipment, the customer must remove any accessories and personal belongings that were not supplied with the product. Where applicable, personal accounts, locks or access must also be removed or disabled.<\/p>\n\n\n\n

          SCUTI cannot be held responsible for personal items or accessories left with a returned product.<\/p>\n\n\n\n

          Electric vehicles and their batteries require suitable packaging in order to be transported safely.<\/p>\n\n\n\n

          The original box, together with all foam inserts, supports and protective materials supplied with the vehicle, must be retained.<\/strong><\/p>\n\n\n\n

          DO NOT DISCARD THE PACKAGING AFTER RECEIVING THE VEHICLE.<\/strong><\/p>\n\n\n\n

          For any collection arranged by SCUTI, the vehicle must be correctly packaged and protected in accordance with the instructions of our after-sales service. SCUTI may require the use of the original packaging where it is necessary for safe and suitable transport.<\/p>\n\n\n\n

          A vehicle must never be shipped in an improvised box, with insufficient protection or in packaging unsuitable for its transport.<\/p>\n\n\n\n

          If the original packaging has not been retained, the customer must contact SCUTI before any shipment. Where SCUTI must provide or send replacement packaging due to the absence of the original packaging, the corresponding costs remain borne by the customer.<\/strong><\/p>\n\n\n\n

          SCUTI may refuse or postpone collection until a suitable packaging solution has been put in place.<\/p>\n\n\n\n

          Damage caused by insufficient packaging or failure to comply with the return instructions is not covered by the warranty.<\/p>\n\n\n\n

          8. Diagnosis and Repair<\/h2>\n\n\n\n

          After diagnosis, SCUTI determines the operations necessary to restore the product to proper working condition.<\/p>\n\n\n\n

          Depending on the problem identified, SCUTI may in particular:<\/p>\n\n\n\n

            \n
          • repair the product;<\/li>\n\n\n\n
          • replace the component concerned;<\/li>\n\n\n\n
          • send a replacement part.<\/li>\n<\/ul>\n\n\n\n

            A repair may be carried out using new or refurbished parts with equivalent characteristics and performance.<\/p>\n\n\n\n

            Where appropriate, SCUTI may offer to send a part so that it can be installed by the customer or by a qualified technician.<\/p>\n\n\n\n

            If the customer does not wish to use this solution, the product must be returned in accordance with the procedure communicated by SCUTI so that the handling of the claim can continue.<\/p>\n\n\n\n

            Labour costs or intervention costs from a third-party workshop are covered only when they have been expressly authorised in writing by SCUTI before the intervention<\/strong>.<\/p>\n\n\n\n

            9. Cases Not Covered by Warranty<\/h2>\n\n\n\n

            If the diagnosis concludes that the problem is not covered by any applicable warranty, warranty coverage is refused.<\/p>\n\n\n\n

            This may in particular be the case where no defect is found or where the problem results from a cause excluded from the warranty.<\/p>\n\n\n\n

            SCUTI may then offer:<\/p>\n\n\n\n

              \n
            • the return of the product;<\/li>\n\n\n\n
            • a paid repair;<\/li>\n\n\n\n
            • paid replacement of the parts concerned.<\/li>\n<\/ul>\n\n\n\n

              Diagnostic fees starting from \u20ac99 including VAT<\/strong> may be applied to cases not covered by warranty.<\/p>\n\n\n\n

              Transport, parts, repair or storage costs may also apply depending on the case.<\/p>\n\n\n\n

              No paid repair is carried out without the customer\u2019s prior agreement.<\/p>\n\n\n\n

              10. Liability Towards Business Customers<\/h2>\n\n\n\n

              The provisions of this section apply only to purchases made in the course of a professional activity.<\/p>\n\n\n\n

              SCUTI cannot be held liable for indirect losses or damages related to the purchase, use, breakdown, unavailability or immobilisation of a product.<\/p>\n\n\n\n

              • loss of turnover, margin or profits;<\/li>\n\n\n\n
              • p\u00e9rdida de ingresos;<\/li>\n\n\n\n
              • p\u00e9rdida de clientes o contratos;<\/li>\n\n\n\n
              • interrupciones de la actividad comercial;<\/li>\n\n\n\n
              • p\u00e9rdida de datos;<\/li>\n\n\n\n
              • p\u00e9rdida de uso;<\/li>\n\n\n\n
              • da\u00f1o a la imagen o reputaci\u00f3n;<\/li>\n\n\n\n
              • costs related to the immobilisation of the product;<\/li>\n\n\n\n
              • costs of renting or using a replacement product;<\/li>\n\n\n\n
              • as well as any other indirect economic or commercial loss.<\/li>\n<\/ul>\n\n\n\n

                In any event, SCUTI\u2019s total liability towards a business customer, for all claims combined, is limited to the price excluding VAT actually paid to SCUTI for the product giving rise to the damage.<\/strong><\/p>\n\n\n\n

                11. Processing Times<\/h2>\n\n\n\n

                Processing times depend on the nature of the problem, the checks required and the availability of parts.<\/p>\n\n\n\n

                Certain repairs may require the ordering of specific components, additional checks or intervention by the manufacturer.<\/p>\n\n\n\n

                Processing times may also be extended by circumstances beyond SCUTI\u2019s control, including supply, transport or manufacturer response times.<\/p>\n\n\n\n

                SCUTI processes requests as quickly as possible depending on these factors.<\/p>\n\n\n\n

                12. Complaints and Dispute Resolution<\/h2>\n\n\n\n

                In the event of a disagreement concerning an order, repair or warranty coverage, the customer must first contact SCUTI in order to allow the case to be reviewed again and an amicable solution to be sought.<\/p>\n\n\n\n

                If no solution is found, the individual customer may refer the matter to the competent mediator or alternative dispute resolution body.<\/p>\n\n\n\n

                If the dispute cannot be resolved amicably or through mediation, each party retains the right to bring the matter before the competent courts.<\/p>\n\n\n\n
